The Usefulness Of California Used Car Lemon Law

If you have just bought a used car and have been experiencing technical difficulties, you could ask for a reimbursement under California Used Car Lemon Law and if the seller refuses to refund, you could take the matter to the court.

The law requires that in case the car sold to you is not good enough and develops defects soon enough, you are entitled to a reimbursement of the money you spent or the replacement of the car unless you have willingly forgone your rights.

So, if the car does not work well and breaks down after some time, it is your right to get a replacement. In fact, the California Used Car Lemon Law is fundamentally a defence against unscrupulous practices of the used car salesmen to sell off a substandard product.

The law takes the side of the purchaser and deals with the manufacturers with an iron hand if they are found at fault. It is not regular to challenge the claims made by the purchaser. Some would take shelter of the principle of 'caveat emptor' while other would argue that the purchaser has somehow violated the terms of warranty and has thus forfeited his right to reimbursement or replacement.

However, because of used car lemon law California has become a litigation prone state with regard to the lemon laws. While the buyers argue breach of warranty, the sellers either plead breach of the conditions of warranty by the buyers or argue 'caveat emptor'. The courts, however, do not take the seller's attempt to scuttle buyers' rights easy.

Not only have court ruled in favour of the purchasers but have also slapped exemplary damages in cases where it was found fit and justified. California auto lemon law in general cannot be taken for granted on account of the strict and clear terms it is coined in and the way they have been interpreted by the courts.

So, if you are buying a used car, make sure that you get it checked by a qualified mechanic and obtain his certificate. Also, take a declaration from the seller in writing that the car is safe to drive and would not develop sudden problems. Once these things are taken care of, the seller cannot escape his liability if you suffer a loss on account of the defects in the car.

You must be careful in this regard though. You not only have to take all the actions required of a prudent buyer but must also keep its record meticulously so that if the need be, the documents could be produced before the court in support of your case.

You can use California Used Car Lemon Law to the best of your benefit, provided you took due care in the beginning.
